PART A – MASTER TERMS OF SERVICE (EXTENDED VERSION)

1. DEFINITIONS

For the purpose of this Agreement:

• “Platform” refers to Releks.je website, application, system and services.
• “Company”, “We”, “Us”, “Our” refers to Al Syarif Digital Solution.
• “User”, “You” refers to any person accessing or using the Platform.
• “Credits” refers to usage tokens required for AI generation.
• “AI Output” refers to any content generated by AI models through the Platform.
• “Access Period” refers to the duration of active account access purchased by User.
• “Third-Party Provider” refers to any external infrastructure, payment gateway, AI provider, hosting service, or integration partner.

2. LEGAL AGREEMENT

These Terms constitute a legally binding agreement between you and Al Syarif Digital Solution.

By:

• Registering an account,
• Purchasing access,
• Using any part of the Platform,

you confirm acceptance of these Terms.

If you disagree, you must cease use immediately.

3. NATURE OF SERVICE

Releks.je is an AI-enabled content generation platform that:

• Facilitates image generation
• Facilitates video generation
• Operates under a credit-based system
• Provides temporary content storage
• Integrates external AI model infrastructure

The Platform acts solely as a facilitation interface and does not:

• Guarantee originality of output
• Guarantee commercial suitability
• Guarantee uninterrupted uptime

4. SERVICE AVAILABILITY DISCLAIMER

You acknowledge that:

• AI services rely on third-party APIs
• Processing speed may vary
• System interruptions may occur
• Output quality depends on AI model behavior

We reserve the right to:

• Modify features
• Update models
• Adjust processing rules
• Temporarily suspend services

without prior notice.

5. ELIGIBILITY & AGE REQUIREMENT

You confirm that:

• You are 18 years or older; OR
• You have parental consent.

We reserve the right to suspend accounts of underage users without refund.

6. ACCOUNT OBLIGATIONS

You agree to:

• Provide truthful information
• Maintain password confidentiality
• Prevent unauthorized use
• Notify us of security breaches

You are liable for all activity under your account.

7. PAYMENT STRUCTURE & CREDIT MODEL

7.1 Access Fee

Access (e.g., RM69 monthly access) grants usage privileges during the Access Period.

Unless stated, access fees are NOT auto-recurring.

7.2 Credit-Based Usage Model

Video generation consumes credits.

• No daily cap.
• No monthly cap.
• Usage is determined solely by available credit balance.

Credit consumption may vary depending on:

• Video duration
• Rendering complexity
• AI infrastructure cost
• Future system updates

We reserve the right to revise credit usage rates.

7.3 Credit Validity

Credits:

• Do not expire unless promotional condition states otherwise.
• Are non-transferable.
• Have no cash value.

7.4 Chargeback Protection Clause

In case of payment disputes or chargebacks:

• Access may be suspended immediately.
• Credits may be revoked.
• Affiliate commissions may be reversed.
• Legal recovery may be pursued.

7.5 Pricing Modifications

The Company reserves the right to:

• Modify, increase, or decrease the pricing of packages, access fees, and credit top-ups at any time.
• Make pricing changes without prior notice to Users.

However, any price modifications will not retroactively affect prior purchases:

• Users who purchased credits or access prior to the price change will retain their credits and access without any additional charges or reductions for the purchased period/amount.

8. AI OUTPUT TERMS

You acknowledge:

• AI may produce similar outputs for different users.
• AI outputs may resemble copyrighted works.
• AI models may generate inaccurate, biased, or incomplete results.

The Company does not guarantee:

• Legal compliance of outputs
• Copyright safety
• Suitability for commercial resale

You assume full responsibility for:

• Reviewing output
• Conducting legal due diligence
• Ensuring compliance with Malaysian law

9. INTELLECTUAL PROPERTY RIGHTS

9.1 Platform Ownership

All platform code, interface design, branding, and system logic remain exclusive property of Al Syarif Digital Solution.

Unauthorized reproduction is strictly prohibited.

9.2 User Generated Content

Subject to compliance:

• Users retain rights to generated outputs.
• Company does not claim ownership.

However, we may temporarily store outputs for processing purposes.

10. ACCEPTABLE USE POLICY (EXPANDED)

Users are strictly prohibited from generating, uploading, or distributing any content that includes or relates to:

• Pornographic material
• Child exploitation material
• Hate speech
• Political election manipulation
• Deepfake impersonation intended to deceive
• Financial scams
• Copyright-infringing material
• Malware or exploitative content
• Content that promotes nudity, immodesty, or attire that is inconsistent with modest dress standards and applicable Shariah compliance principles

For the avoidance of doubt:

The Platform does not permit the generation of images or videos depicting individuals in revealing, sexually suggestive, or non-modest attire, including content that contradicts principles of Islamic modesty and Shariah-aligned ethical standards.

We reserve the sole discretion to determine whether content violates this provision.

Violation of this policy may result in:

• Immediate suspension of account
• Forfeiture of credits
• Permanent termination without refund

The Company reserves the absolute right to restrict any content deemed morally inappropriate, culturally insensitive, or inconsistent with the ethical framework adopted by the Platform.

11. DATA STORAGE & AUTO-DELETION

Generated content:

• Stored temporarily
• Automatically deleted within 24 hours
• Not archived permanently

We are not responsible for:

• User failure to download content
• Data loss after deletion

Security logs may be retained for compliance purposes.

12. LIMITATION OF LIABILITY (EXPANDED)

To the fullest extent permitted by Malaysian law:

We shall not be liable for:

• Indirect damages
• Loss of business opportunity
• Loss of goodwill
• Loss of anticipated profits
• Data loss
• Legal claims from third parties

Maximum aggregate liability shall not exceed total fees paid in last 30 days.

13. INDEMNITY CLAUSE (STRONG VERSION)

You agree to indemnify and defend Al Syarif Digital Solution against any:

• Legal claim
• Financial loss
• Regulatory penalty
• Legal cost

arising from:

• Your use of AI output
• Your misuse of platform
• Your violation of laws
• Your infringement of third-party rights

14. THIRD-PARTY PROVIDERS

We are not liable for:

• Bayarcash disruptions
• AI model provider downtime
• Hosting provider outages
• API rate limits

Your continued use constitutes acceptance of such dependencies.

15. FORCE MAJEURE

We are not liable for failure or delay due to:

• Natural disasters
• Government regulation
• Cyber attacks
• Infrastructure collapse
• Third-party service shutdown

16. TERMINATION RIGHTS

We may terminate or suspend accounts:

• For violation
• For suspected fraud
• For abuse

At our sole discretion.

No refund shall be issued upon termination due to breach.

17. DISPUTE RESOLUTION

Disputes shall be:

• Governed by Malaysian law
• Subject to Malaysian court jurisdiction

Optional clause:

• Arbitration before court proceedings.

PART C – AFFILIATE AGREEMENT (EXTENDED)

Affiliates must:

• Avoid false claims
• Avoid spam
• Avoid income exaggeration

Commission may be withheld for:

• Fraud
• Chargebacks
• Abuse

We reserve sole authority to determine commission validity.

PART D – COPYRIGHT & NOTICE PROCEDURE

Upon receiving valid notice:

• We may temporarily disable content
• Investigate claim
• Remove material if justified

False claims may result in legal action.

PART E – REFUND POLICY (DETAILED)

Refunds only for:

• Duplicate charges
• Confirmed system malfunction
• [SPECIAL EXCEPTION] Third-party model provider shut down (e.g., Sora 2 permanent closure). In this specific event, refunds will only be issued based on the remaining unused credits in the user's account.

Not eligible:

• Change of mind
• Violation suspension
• Unused credits (under normal operating circumstances)

ADDITIONAL PROTECTIVE CLAUSES

18. NO WARRANTY (COMPREHENSIVE DISCLAIMER)

The Platform is provided strictly on an:

• "AS IS"
• "AS AVAILABLE"
• "WITHOUT WARRANTY OF ANY KIND"

We expressly disclaim all warranties including but not limited to:

• Merchantability
• Fitness for particular purpose
• Non-infringement
• Accuracy
• Reliability
• Uninterrupted service
• Error-free functionality

We do not guarantee:

• AI outputs are unique
• AI outputs are commercially safe
• AI outputs are legally compliant
• AI outputs are free from bias

Use of the Platform is entirely at User’s own risk.

19. SERVICE LEVEL DISCLAIMER

Releks.je does not provide guaranteed uptime.

We do not guarantee:

• Minimum uptime percentage
• Specific rendering speed
• Guaranteed delivery time

Service interruptions may occur due to:

• Maintenance
• Infrastructure updates
• Third-party outages
• Traffic spikes

No compensation shall be payable for downtime.

20. BETA FEATURES CLAUSE

We may introduce beta or experimental features.

Beta features:

• May be unstable
• May change without notice
• May be removed permanently

Use of beta features is entirely at user’s own risk.

21. SYSTEM ABUSE & FAIR USAGE PROTECTION

Although no daily or monthly cap exists, users must not:

• Use automated scripts to overload system
• Attempt stress testing
• Circumvent credit system
• Reverse engineer API behavior

We reserve the right to:

• Rate limit accounts
• Temporarily suspend processing
• Terminate abusive users

No refund will be issued for abuse violations.

22. REGULATORY COMPLIANCE

Users are solely responsible for ensuring compliance with:

• Malaysian Communications and Multimedia Act 1998
• Penal Code (Malaysia)
• Copyright Act 1987
• PDPA 2010
• Any applicable international law

The Company shall not be liable for regulatory violations caused by user content.

23. AUDIT & MONITORING RIGHTS

We reserve the right to:

• Monitor system usage
• Log suspicious activity
• Investigate abnormal usage patterns
• Freeze credits under fraud suspicion

Monitoring is conducted for security and compliance purposes.

24. TAX RESPONSIBILITY

Users are responsible for:

• Reporting income derived from AI outputs
• Paying applicable taxes
• Ensuring lawful commercial usage

The Company is not responsible for users’ tax obligations.

25. CORPORATE LIABILITY SHIELD

Al Syarif Digital Solution operates as a registered entity in Malaysia.

Under no circumstance shall:

• Owner
• Directors
• Staff
• Contractors

Be personally liable for claims arising from use of the Platform beyond statutory obligations.

26. MODIFICATION OF AI MODELS

We reserve the right to:

• Change AI model providers
• Upgrade models
• Downgrade models
• Replace infrastructure

Such changes may affect output quality or credit consumption.

No compensation shall be owed due to model change.

27. ARBITRATION CLAUSE

Before initiating court proceedings, parties agree to:

• Attempt good faith negotiation
• Consider mediation
• Consider arbitration within Malaysia

28. CLASS ACTION WAIVER

Users agree not to:

• Initiate class action
• Join collective legal claims

All disputes must be handled individually.

29. SEVERABILITY

If any provision is deemed invalid:

Remaining provisions remain enforceable.

30. ASSIGNMENT

We may transfer or assign:

• Rights
• Obligations
• Assets

In case of merger, acquisition, or restructuring. Users may not assign their account without consent.

31. WAIVER

Failure to enforce any provision shall not constitute waiver of rights.

32. ENTIRE AGREEMENT

These Terms constitute the entire agreement between User and Company.

33. SURVIVAL CLAUSE

The following survive termination:

• Limitation of liability
• Indemnification
• Intellectual property
• Dispute resolution
